Employees have the right not to be unfairly dismissed subject (in most cases) to a minimum continuous period of service 2 years’ service. Unfair dismissal occurs when a dismissal takes place without one of the potentially fair reasons (Capability, Conduct, Redundancy, Breach of a Statutory Restriction or Some other substantial reason) for dismissal applying. If an employer establishes a potentially fair reason for dismissing an employee they also have to show that the acted reasonably in treating the chosen potentially fair reason as a sufficient reason to justify dismissing the Employee.
